§ 1. Introduction
  1. The present Terms and Conditions of Service (hereinafter referred to as Regulations) shall apply to all present and future business relations connecting GEMINI BTJ, represented by Mark Szlachta, with contractors (hereinafter referred to as Clients) within the scope of GEMINI BTJ activities.
  2. The Terms and Conditions are addressed to all Users and Clients who use the GEMINI BTJ, DŻEMINAJ and GEMBOOK websites.
  3. With regard to services provided electronically, this document is the Regulations referred to in Article 8 of the Act of July 18, 2002 on providing services electronically (Journal of Laws of 2002, No. 144, item 1204, as amended).
  4. The provider and operator of the GEMINI, DŻEMINAJ and GEMBOOK services is Gemini Language Translation Bureau Marek Szlachta located at: ul. Szwajcarska 3/20, 20-861 Lublin, Poland, tel. +48 607 062 862, entered in the Business Activity Register of the Department of Administrative Affairs of the Municipal Office in Lublin under number 31434 and having NIP number 946-177-84-75 and REGON number 430 468 960.
  5. It is forbidden for the User and the Client to use the GEMINI, DŻEMINAJ and GEMBOOK services in a manner contrary to the law, good morals or violating the legitimate interests of GEMINI BTJ. In particular, the Client and the User shall not take actions that could expose GEMINI BTJ to any property or image damage.
  6. All information contained and displayed through GEMINI, DŻEMINAJ and GEMBOOK services relating to services, including their prices, does not constitute a commercial offer within the meaning of Article 66 of the Civil Code, but an invitation to conclude a contract as defined in Article 71 of the Civil Code.
  7. The object of providing services by GEMINI BTJ is the performance of ordinary and specialized non-certified (non-certified) written translations, and in addition, proofreading and editing of written texts, printing work (DTP) necessary for translation, proofreading and editing, as well as anti-plagiarism verification of texts.
  8. The Polish version of these Regulations is the only legally sanctioned version and only this one may constitute the basis for the activities of GEMINI BTJ or the basis for explaining and resolving disputes between GEMINI BTJ and Clients. Other language versions of the Regulations constitute only a view of the essence of GEMINI BTJ's activities and cannot be considered binding in any matter.
§ 2. Terms and Definitions
  1. GEMINI BTJ - the provider of the services listed in these Terms and Conditions and the operator of the GEMINI, DŻEMINAJ and GEMBOOK websites.
  2. Client - recipient of services offered by GEMINI BTJ.
  3. Order - an instruction to perform a service by GEMINI BTJ in exchange for financial compensation from the Client.
  4. Invoice - a document of sale of a service containing details of the transaction, issued by GEMINI BTJ to the Client.
  5. Electronic payment - a non-cash transaction conducted over the Internet using any electronic device. In GEMINI BTJ, the Client can make electronic payments through the Przelewy24 system.
  6. Source text (source language) - the text to be translated, corrected or verified.
  7. Target text (target language) - the result of the correction, verification or translation process into the target language.
  8. Regular translation - the translation of information from one language into another, not requiring the involvement of specialized knowledge in a particular field.
  9. Specialized translation - the translation from one language into another of information, the understanding and translation of which require specialized knowledge of a particular field.
  10. Uncertified (unsworn) translation - translation of information from one language into another without certification of conformity to the original in the form of a sworn translator's name stamp. Uncertified translations usually cannot be submitted to authorities of state institutions.
  11. Native speaker translation - in addition to the standard translation from one language to another, includes text editing, i.e. extended proofreading, i.e. thorough checking of both typographical, lexical, stylistic, as well as most factual errors; there is the possibility of style guides required by some Editorial Boards; performed by native speakers of the target language.
  12. Basic proofreading - provides only checking of typos, double spaces, grammatical forms of words and syntax of sentences.
  13. Native speaker proofreading - provides a thorough check for technical defects in the text (typos, double spaces, etc.), grammar, punctuation and spelling; also improves readability, clarity, conciseness and choice of vocabulary where appropriate; performed by native speakers of the target language from birth.
  14. Native speaker editing - provides a comprehensive, content-focused review; makes logical and factual corrections; includes proofreading, but also includes basic fact-checking, rewriting passages for clarity and conciseness, editing, and changing the style of the text; performed by native speakers of the target language.
  15. Linguistic quality assessment (LQA) - an estimate of the correctness of the target text in terms of accuracy, consistency, vocabulary, grammar, punctuation and localization, expressed by a number from 0-10.
  16. Anti-plagiarism verification - comparing the content with the widest possible set of published texts posted on the Internet, in addition to checking for the existence of typical text patterns generated by artificial intelligence (AI); similarity to already existing texts is expressed as a percentage.
  17. Printing services (DTP) - the preparation of a document for publication in electronic form, such as converting files, editing graphics, positioning graphic and textual elements on the publication page, etc.
§ 3. Technical Parameters
  1. In order to use GEMINI, DŻEMINAJ and GEMBOOK services, it is sufficient to have an electronic device with an installed browser capable of displaying web pages. The browser should have installed and properly functioning scripting software, in particular PHP and JavaScript.
  2. The basis for financial settlements between the Client and GEMINI BTJ is the number of words of the text to be translated, proofread or edited (source). This number is read from the Word Statistics in MS Word. At the Client's request, the basis of billing may be a billing page or a publishing sheet with the exception that GEMINI BTJ will use the following conversion rates: 1 billing page = 250 words = 1,800 characters with spaces and 1 publishing sheet = 5555.55 words = 40,000 characters with spaces. In doing so, prices and order value are converted to 1 word.
  3. Text for translation, proofreading or editing (source) should be provided in the form of a file in the format of popular word processors (DOC, DOCX, TXT, RTF, etc.) or other previously agreed format (e.g. PDF, PPT, JPG) and the same form has the target text.
  4. Only the actual translated, corrected or edited portions of the text are included in the billing. Graphics may be subject to DTP service after acceptance by the Client, however, DTP service cannot be an independent order in GEMINI BTJ - it is only an additional service to the translation, proofreading or editing performed.
